Where and How Divorce Cases are Filed in Solano County?
Solano County divorce cases are handled in the Superior Court of California, County of Solano, specifically the Family Law Division at 600 Union Avenue, Fairfield.

File in person
To file in person, you must schedule your visit through the court’s online portal; you can also schedule 30-minute walk-in appointments.
Use a court drop box
You can also submit documents via a drop box located at either the Fairfield location or the Vallejo location. Documents submitted into the drop box prior to 11:30 am will be available for pickup by the end of the next business day. If you require a document earlier than this time frame, request it be picked up at the Fairfield location.

Attorneys must e-file their paperwork; however, self-represented individuals can submit divorce papers electronically through a certified e-filing service provider or on paper.
Do You Meet the Solano County Residency Requirement?
Before filing, at least one spouse must have been a California resident for at least 6 months and a Solano County resident for at least 3 months before filing, under Family Code § 2320. At least one spouse must meet this qualification.

For example, a Fairfield resident who has lived in Fairfield for only 2 months will not meet the county rule’s requirements, regardless of where his or her spouse resides.
In that case, he or she may file for legal separation instead, and later amend it once he or she meets the qualifications.

Which Solano Filing Path Fits Your Situation?
In 2026, you can file three types of forms. The right filing depends on which qualifications you meet.

Summary Dissolution (FL-800)
- Summary Dissolution (FL-800) is available to couples who were married for less than five years, have no minor children together, and neither spouse is currently pregnant.
- Summary Dissolution has many additional financial and property restrictions; review each one before applying.
SB 1427 Joint Petition (FL-700)
- Since January 1, 2026, SB 1427 includes the FL-700 Joint Petition for those who have agreed on their divorce terms.
- Each party completes this jointly and signs it as Petitioner 1 and Petitioner 2. You will then use a joint summons, so neither party has to formally serve the other.
- The filing fee alone is approximately $870. If either party wishes to request a temporary court order, use standard dissolution.
Standard Uncontested Dissolution (FL-100)
- Use a Standard Uncontested Dissolution (FL-100) when one party files the dissolution paperwork first and serves the other spouse, or when the FL-700 Joint Petition is not feasible.
- The filing fee for an uncontested dissolution typically ranges from $435–$870, depending on whether the opposing party responds to the initial filings.
- However, once a party disputes any part of the dissolution papers, the case becomes contested and may require hearings or trials.

The Step-by-Step Filing Walkthrough for Solano County, California
Divorce in Solano County follows these 6 steps: (1) preparing your divorce documents, (2) filing those papers with the court, (3) serving your spouse with a copy of your divorce paperwork (if necessary), (4) exchanging financial information about each party, (5) coming to an agreement on all issues related to your divorce, (6) having the court enter that agreement as a judgment.

- 1
Step 1: Prepare Your Forms
Determine which filing option best fits your situation. Verify your answers are accurate, sign every page appropriately, and double-check all numbers and amounts for accuracy. Failure to do so may result in rejection and require resubmission.
- 2
Step 2: File With the Court
Send all your paperwork to the Superior Court (Solano) using one of the court’s accepted methods. Also, pay the filing fee for the case you are filing, or complete the form requesting a fee waiver based on income eligibility. Make sure you have kept a copy of all documentation submitted.
- 3
Step 3: Serve Your Spouse, If Required
If you’re filing a simple dissolution of marriage, properly serve your spouse with the filed paperwork. However, as previously stated, you can’t serve the papers yourself.
When using the Joint Petition Process for Dissolution of Marriage, other rules apply to service between the parties.
- 4
Step 4: Exchange Financial Disclosures
Complete your financial disclosure and send all documentation associated with it (i.e., assets, liabilities, tax returns). Even if you’ve agreed on “how” you will divide the marital property, follow the financial disclosure guidelines.
- 5
Step 5: Reach and Document an Agreement
Determine what needs to be decided regarding property, debts, spousal support, and/or children (if applicable), and record these agreements in your settlement agreement.
If you still disagree, you may need to continue negotiating, seek mediation, or take your case to trial.
- 6
Step 6: Submit the Judgment Packet
Fill out all the judgment forms required, and file them with the court. Respond to any items that are addressed to you from either the Clerk’s Office or the Judge. A divorce is final only after the Judge enters a Judgment.
