Judgment of Divorce in California: What It Is and When You Are Legally Single

A judgment of divorce is the court order that legally ends your marriage. In California it is recorded on form FL-180, and in most cases your Marital Settlement Agreement is attached to it. Until a judge signs the judgment and the clerk enters it, you are still married, no matter how long ago you separated or how completely you agree.

This page explains what the judgment actually does, how the MSA fits inside it, the exact date you become legally single, and what you must do once it is entered. For the line-by-line form instructions, see our FL-180 guide.

What Is a Judgment of Divorce?

A judgment of divorce, also called a judgment of dissolution of marriage, is the final court order in a California divorce case. It does three things at once:

  • Ends the marriage. It restores both spouses to single status on a specific date.
  • Makes your agreement enforceable. Terms about property, debt, support and children stop being a private arrangement and become court orders, backed by the court’s contempt and enforcement powers.
  • Closes the case. It is the last substantive filing in an uncontested divorce.

California does not issue a separate document called a divorce decree or a divorce certificate. The entered FL-180 is your decree. Together with the FL-190 Notice of Entry of Judgment, it is the proof you show a lender, an employer, an immigration officer or a future spouse.

A judgment can be reached three ways: by agreement (both sign an MSA), by default (your spouse never responded within 30 days of service), or by trial (a judge decides contested terms). The overwhelming majority of California divorces end by agreement or default, which is why most people never see the inside of a courtroom.

I highly recommend The Complete Divorce to anyone trying to navigate the divorce process on their own. Going into this, I really didn’t know where to start or how to make sure I was completing everything correctly, and this service made the entire process much easier to understand and manage. The platform was extremely helpful with completing the necessary forms and, just as importantly, gave me the framework and guidance I needed to put together my Marital Settlement Agreement. Having everything laid out and explained helped take a lot of the uncertainty out of the process. The Zoom calls with Dina were also incredibly valuable. Being able to ask questions directly and get clarification on things I wasn’t sure about gave me a lot more confidence that I was handling everything correctly. Divorce is already stressful enough without trying to figure out all of the paperwork and requirements on your own. The Complete Divorce provided the resources, guidance, and support I needed to successfully navigate the process. I’m very grateful I found it and would absolutely recommend it to anyone going through a divorce and looking for help managing the process themselves.

I was looking for a divorce attorney but it was so expensive. I figured I could do it on my own. This divorce service is a "guided DIY" so you get help from their family law team. They created really easy to use software. I got everything I needed to do my divorce quickly and easily. I did the package that included time with the team so I knew I did it correctly. Still inexpensive compared to others. It was worth it. Thank you Dina, Deborah, and Samira.

As a marriage and family therapist, I've worked with Dina and The Complete Divorce from the start of the business. I don't know any other professional that has the heart and services for people divorcing in California. The program offerings are exceptional. Don't file for a CA divorce without first checking with them. They have so many options and strategies to offer.

What Is an MSA, and How Does It Fit Into the Judgment?

An MSA is a Marital Settlement Agreement: the written contract in which you and your spouse set out every term of your divorce. It covers how community property and debt are divided, whether spousal support is paid and for how long, child custody and a parenting schedule, and child support figures.

The relationship between the two documents is the part people find confusing, so here it is plainly:

  • The MSA is your agreement. You write it, you both sign it.
  • The judgment is the court order. The judge signs it.
  • The MSA is attached to the judgment and incorporated into it. That attachment is what converts a private contract into something a court will enforce.

This matters practically. If your spouse stops paying support under a signed MSA that was never incorporated into a judgment, your remedy is a breach of contract lawsuit. If the same MSA is part of an entered judgment, you can go back to the family court and use wage garnishment, liens and contempt. Same words, very different enforcement power.

One rule causes more rejections than any other: the FL-180 and the MSA must agree exactly. If the judgment form says support ends in 2029 and the agreement says 2030, the judge sends the packet back. Our marital settlement agreement guide covers drafting it clause by clause.

What Goes Into a California Judgment Packet

Courts do not accept the FL-180 on its own. You file a packet, and which forms it contains depends on your case:

  • FL-180 Judgment, the cover order itself
  • Marital Settlement Agreement, attached, in agreed cases
  • FL-170 Declaration for Default or Uncontested Dissolution, the sworn statement that the case can be decided without trial
  • FL-141 proving financial disclosures were exchanged (see our disclosures guide)
  • FL-341 if there are custody and visitation orders
  • FL-342 plus a guideline calculation if there is child support
  • FL-343 if there is spousal support
  • FL-190 Notice of Entry of Judgment, with stamped envelopes for both parties

Every box you tick on the FL-180 triggers a required attachment. Ticking a box without attaching its form is the most common reason packets come back, and each round trip costs weeks on top of the mandatory six-month wait.

When Are You Legally Single in California?

Your marriage ends on the termination of marital status date written into the judgment. That date is never earlier than six months and one day after your spouse was served with the petition and summons.

Three things people commonly get wrong:

  • The clock starts at service, not at filing. If you filed in January but did not serve until April, your earliest possible end date is October, not July.
  • Signing the MSA does not end the marriage. Only entry of the judgment does.
  • The six months cannot be waived. Not by agreement, not for hardship, not for a simple case. It is statutory.

Court processing adds to it. Most California courts take four to twelve weeks to review and enter a judgment, depending on county backlog, so a realistic uncontested timeline is six to nine months. Call the clerk about four weeks after filing to confirm your packet was accepted, and read our guide to how long a California divorce takes.

Once entered, you receive the FL-190. Keep it: it is the document that proves you are free to remarry.

What to Do After the Judgment Is Entered

A judgment orders things to happen. It does not make them happen. These are yours to action:

  • Retitle real property. A deed, usually an interspousal transfer deed, moves the house into one name. The judgment alone does not change the title at the county recorder.
  • Divide retirement accounts. A pension or 401k normally needs a separate order, a QDRO, drafted and approved on its own. People forget this for years and then find the account was never split.
  • Update beneficiaries. Life insurance, retirement plans and payable-on-death accounts pay whoever is named, regardless of what your judgment says.
  • Separate the finances. Close joint accounts and joint credit cards. A creditor can still pursue you on joint debt even when the judgment assigns it to your ex.
  • Revise your estate plan. Your will, trust and powers of attorney should be rewritten.
  • Set up support payments through the state disbursement unit if a wage assignment was ordered.

Enforcing and Changing a Divorce Judgment

Enforcement. If your ex ignores the judgment, the court has real tools: wage garnishment for support, liens on property, levies on bank accounts, interception of tax refunds, suspension of a driver or professional licence, and contempt proceedings. Unpaid California support accrues interest at ten percent a year and does not expire.

Modification. What can change later depends on the category:

  • Child custody and support can always be revisited when circumstances change materially, such as income, relocation or the child’s needs. Children’s rights cannot be bargained away permanently.
  • Spousal support is usually modifiable unless your MSA expressly made it non-modifiable, which is binding and permanent, so read that clause carefully before signing.
  • Property division is final. Once entered it generally cannot be reopened, except where an asset was concealed or the judgment was obtained by fraud, duress or serious mistake.

That asymmetry is the strongest argument for getting the property terms right the first time, and for completing your financial disclosures honestly.

Why California Judgment Packets Get Rejected

  1. The FL-180 and the MSA do not match. Any difference in dates, amounts or names sends it back.
  2. A ticked box with no attachment. Custody ticked but no FL-341, support ticked but no FL-342 or FL-343.
  3. Disclosures incomplete. No FL-141 on file means no judgment, however amicable the divorce.
  4. The six months had not run. A termination date earlier than six months and one day from service is rejected automatically.
  5. Outdated form revisions. Judicial Council forms are revised periodically and clerks reject superseded versions.
  6. Child support below guideline with no explanation. Parents can agree to a different figure, but the court needs the required declarations.

None of these are legal judgment calls. They are procedural, which means they are entirely preventable with a checked packet.

Judgment of Divorce: Frequently Asked Questions

It is the final court order that legally ends a marriage, recorded on form FL-180. It restores both spouses to single status, turns the terms of your settlement into enforceable court orders, and closes the case. California does not issue a separate divorce decree, the entered FL-180 is the decree.

MSA stands for Marital Settlement Agreement, the written contract where spouses set out how property and debt are divided and how custody and support will work. It is attached to the FL-180 and incorporated into the judgment, which is what makes it enforceable by the court rather than only as a private contract.

No. The MSA is the agreement you and your spouse sign. The judgment is the order the judge signs. The MSA is attached to and incorporated into the judgment. An MSA that is never incorporated can only be enforced by suing for breach of contract, not through the family court.

On the termination of marital status date written in the judgment, which can never be earlier than six months and one day after your spouse was served. The clock runs from service, not filing, and the waiting period cannot be waived. Most uncontested cases finalise in six to nine months.

California does not issue a separate divorce certificate. Your proof is the entered FL-180 judgment plus the FL-190 Notice of Entry of Judgment. You can request certified copies from the clerk of the court where your case was filed.

Child custody and child support can always be modified when circumstances change materially. Spousal support is usually modifiable unless the MSA made it expressly non-modifiable. Property division is final once entered and can generally only be reopened for concealed assets, fraud or serious mistake.

You can enforce it through the family court using wage garnishment, property liens, bank levies, tax refund interception, licence suspension and contempt proceedings. Unpaid California support accrues interest at ten percent a year and does not expire.

Most California courts take four to twelve weeks to review and enter a judgment packet, depending on the county and its backlog. Contact the clerk around four weeks after filing to confirm it was accepted. A rejected packet restarts the review queue but not the six-month waiting period.
