## Can You File for Divorce If Your Spouse is in Another Country?

Yes. In California, you are able to file for divorce regardless of whether your spouse resides within the United States or in a foreign country. California law only requires that one spouse establish their residency within the state prior to a divorce proceeding. 

According to **California Family Code Section 2320**, both spouses (or at least one) must reside in California for a minimum of 6 months preceding the filing date and in the county where the petition was filed for a minimum of 3 months immediately preceding the filing date. 

The spouse residing outside the United States need not be a California resident or a U.S. resident. The primary concern in international divorces is generally the proper service of divorce documents in the country where your spouse is located. 

Service procedures vary significantly among countries, and errors in this regard will frequently cause delays and/or result in the inability of the court to enter an appropriate judgment in your case.

### Explaining the california residency rule for divorce

As previously mentioned, a couple is required to have at least one spouse who has lived in California for six (6) months and in the county where the petition will be filed for three (3) months prior to filing for dissolution. 

There are no requirements that each party meet this requirement. Typical ways to show residency include:

 

- A valid CA Driver’s License or State I.D.
- Utility Bills 
- Lease Agreement / Mortgage Records
- CA Tax Filings
- Employment Records
- Voter Registration Records

Even if you now reside outside of the United States, it is possible for you to pursue a dissolution action in the courts of California if you continue to claim California as your home or domicile. 

On the other hand, if you no longer meet the above requirements for residency in the state of California, then your spouse can pursue a dissolution if they qualify.

## How to File for Divorce in California When Your Spouse is Abroad?

Getting a divorce when the other partner is overseas is almost the same process as a standard divorce. You mainly file the case, serve your spouse the right way, exchange disclosures, and then obtain a judgment.

### Step 1 — Filing the divorce petition in your county

Beginning by filing form [FL-100 Petition for Dissolution of Marriage](https://thecompletedivorce.com/fl-100-petition-divorce-online-california/), in the county’s superior court, where the requirements for residency are fulfilled.

The cost of filing is usually between $435 and $450. However, those who meet certain qualifications may request a fee waiver using [form FW-001](https://courts.ca.gov/sites/default/files/courts/default/2024-11/fw001.pdf). ### Step 2 — Serving your spouse internationally — the most important step

After the [divorce papers](https://thecompletedivorce.com/california-divorce-forms/) are filed, you must legally give them to your spouse. The court will need evidence that this delivery was done as it should be. 

Which procedure is followed depends on whether the state your spouse is living in allows international mail, a personal process server, or a Hague Convention process. 

As soon as the papers have been delivered, [Form FL-115 (Proof of Service of Summons)](https://thecompletedivorce.com/california-form-fl-115-proof-of-service-of-summons-guide/) is used by you to present to the court that they were delivered to their spouse.

### Step 3 — Wait for response

Once legal service is completed, your spouse usually has thirty (30) days in which to submit a response [(FL-120](https://thecompletedivorce.com/fl-120-how-to-complete-the-response-forms-for-a-ca-divorce/)) to the Court. The time for responding starts when the service is completed.

Two outcomes are possible:

- If your spouse submits a response, the case will be treated either as an [uncontested divorce](https://thecompletedivorce.com/cheap-uncontested-divorce-in-california/) if you agree on all issues or as a contested divorce if you need to go to a trial to resolve any final divorce issues, e.g. permanent spousal support or property division. - If your spouse fails to submit a response within the required time frame, you can petition the Court for a default and seek to have the divorce finalized without your spouse’s involvement. ### Step 4 — Complete financial disclosures

Regardless of whether your spouse lives in California or elsewhere, both parties are obligated to disclose their respective financial information to one another. [Form FL-140 Declaration of Disclosure](https://thecompletedivorce.com/fl-140-form-declaration-of-disclosure-ca-divorce/) lists the documentation being disclosed, and [Form FL-141](https://thecompletedivorce.com/fl-141-declaration-service-disclosure-income/) verifies that you have delivered this documentation to your spouse. 

By providing each party with knowledge of the property, liabilities, income, and expenses that existed in the marriage prior to the entry of a final judgment, the financial disclosure process helps prevent later disputes over the division of these items.

In a default divorce proceeding, the filing spouse must provide the necessary financial disclosures; however, other rules may govern a non-responsive spouse’s ability to comply.

### Step 5 — Finalize your divorce judgment

Once you’ve met your obligations as described in the previous section, you will need to send the completed judgment packet (including [Form FL-180](https://thecompletedivorce.com/fl-180-judgment-form-california-divorce/)) to the judge for approval. 

Generally, if the divorce is uncontested and both spouses have signed the required documents, the process of finalizing the divorce will typically go smoothly. 

If this is a default case, there may be other forms that you’ll need to complete (Form FL-170) prior to the Court entering your Divorce Judgment.

The biggest issue with divorcing someone overseas is that the courts can quickly reject your proof of service if service does not comply with California law. 

This will eventually delay your case or cause the judge to refuse to enter a judgment.
Here’s how to properly serve a spouse living in another country:

### 1. Service by international certified mail

In certain circumstances, California allows service via mail on a spouse who resides outside of the U.S. However, not all countries allow the service of legal documents from another country using international mail. 

Before using this method of service, determine whether the country where the spouse resides permits service of process by foreign courts. 

Service is normally accomplished by sending the necessary divorce documents and obtaining proof of delivery that meets California’s court service requirements.

### 2. Waiver of service: is it possible?

Yes. As long as your spouse is cooperative, they could agree to accept your divorce papers without going through the formal procedure to serve them. 

Most waivers are performed using a Notice and Acknowledgment of Receipt. Using a waiver can help save time and money for both parties. 

Waivers also help avoid delays associated with international service. Waivers are most helpful in friendly and unopposed divorce actions.

### 3. The hague service convention

The Hague Service Convention is an International Treaty that established methods for serving legal documents between signatory nations. 

Normally, the document(s) are sent through a designated Central Authority in the nation to which the documents are being delivered. 

The processing time varies; however, there is normally at least a three-month wait for completion of service. For spouses residing in non-signatory countries, international service regulations may differ significantly.

### 4. Service by publication

Service by publication should be used only after you have exhausted all avenues attempting to locate your spouse. 

Prior to proceeding with service by publication, you must first obtain judicial approval and demonstrate to the Court that you made good faith efforts to locate your spouse. 

Your notice will be posted in a Court-approved newspaper in the area designated by the Court for a specified amount of time.

## What Happens If Your Spouse Ignores the Divorce Papers? (Default Divorce)

If your spouse is living outside of California and does not acknowledge the divorce paperwork, it is possible for you to get a default divorce based upon the fact that you were properly served. 

The key factor is whether the proper steps have been taken to complete the service. The time frame for your spouse to respond to the service begins after they have been legally served with the process. 

Once the time frame expires and your spouse fails to file any pleadings, you can ask the Court to place them in default and proceed with the case without their involvement. 

You could also be the Petitioner in this case if you meet the California residency requirements, even though your spouse resides outside of California. 

Either spouse can initiate the divorce proceedings in an amicable divorce proceeding, and the other spouse will be considered the Respondent. 

Both spouses must agree to each term of the divorce proceeding in order to consider it an uncontested case. 

California law governs property division regardless of where the other spouse resides. If foreign assets/debts are involved, there may be legal and/or practical challenges. 

In many uncontested divorces, foreign assets/debts are resolved by way of a [Marital Settlement Agreement (MSA)](https://thecompletedivorce.com/marital-settlement-agreement-divorce-california/).

## Will Your California Divorce Be Recognized in Your Spouse's Country?

It’s possible they won’t. There isn’t a single treaty that requires all countries to recognize a California divorce. The foreign government will look at its own domestic law, how its courts are organized, and what policies govern the recognition of foreign divorces. 

Foreign governments have varying degrees of willingness to recognize foreign divorces; some may need more than just an acknowledgment of the divorce.

If you or your ex-spouse are planning on getting married again outside of the United States, it would be helpful to confirm prior to the ceremony if the state/country where you plan on getting married has acknowledged your California divorce. 

This could potentially cause problems for you both. Consult with attorneys in the area before making travel arrangements.
