Most California divorces actually finish without either spouse ever standing in front of a judge. And for a divorce without a court, you need to think of two things; how to identify the right [type of divorce](https://thecompletedivorce.com/types-of-divorce-california/), how to file it, and how to reach an agreement. 

Reaching an agreement is the critical part. You can do this through [mediation](https://ffmediation.com/practice-areas/california-divorce-mediation-services/), [TCD’s fully guided divorce](https://thecompletedivorce.com/low-cost-divorce-in-california/), and/or collaborative divorce.  Mediation is also helpful even [if you’ve slight disagreements](https://thecompletedivorce.com/contested-to-uncontested-divorce-california/) — i.e., in other words your case is contested — as [mediation can really switch to uncontested one](https://thecompletedivorce.com/cheap-uncontested-divorce-in-california/). 

While options like a [joint petition](https://thecompletedivorce.com/fl-700-joint-petition-california/), summary dissolution, and TCD’s “We File for You” can help with “how to file it” part—getting that agreement onto paper so that a judge can finalize it.

Here is a look at many of the alternatives you can use in California.

### 1. Divorce mediation

In [divorce mediation](https://ffmediation.com/), [the mediator](https://ffmediation.com/divorce-mediator/) — a single neutral professional — helps both spouses work through the terms of [divorce or legal separation](https://thecompletedivorce.com/california-divorce-or-legal-separation/), such as dividing property and debt, spousal and child support, and a parenting plan.

The mediator doesn’t decide anything; rather, they help both parties take control of the divorce and decide for themselves until they reach a solid, mutually agreeable agreement. 

Once you’ve agreed, the mediator writes everything up as a [Marital Settlement Agreement](https://thecompletedivorce.com/california-marital-settlement-agreement-guide/) (MSA). That MSA gets filed alongside your judgment paperwork, a judge signs the judgment without you in the room, and that’s it — literally without a hearing or court appearance.

**How long it takes:** There’s no fixed answer, as it depends on the complexity of the case and the mediator’s competence. A complex mediation may take 3–6 months, while an uncomplicated case can be settled in as few as two to four sessions. Just remember that California puts a six-month waiting period on every divorce, which starts from the day your spouse is served — or, in a joint filing, from the day you file. So even if you sort out everything in one afternoon, you still can’t be legally single until those six months are up.

**How much it costs:** Mediation is an [affordable option](https://ffmediation.com/california-divorce-mediation-cost/) in California. For a typical California case, plan on somewhere around $3,000 to $8,000 in mediator fees total, usually split between the two of you. For complex mediation, it can climb past $15,000 — still far cheaper than contested litigation, which could cost a single party $30,000+.

**When mediation is a poor fit.** Mediation only works when both people are willing and cooperative. Litigation is the better option to consider if the case involves domestic violence or power imbalances. ### 2. Collaborative divorce

Collaborative divorce is a team-based process that stays out of court by design. In this form of ADR (alternative dispute resolution), each party hires their own collaboratively trained attorney. 

The couple also brings in and shares neutral professionals like a financial specialist, a divorce coach, and a child specialist. Everyone signs a participation agreement and commits, up front, to settling without litigation.

However, if the process falls apart and either spouse heads for court, both collaborative attorneys have to step aside, and the couple starts over with new litigation lawyers. That built-in penalty for failure keeps everyone aimed at a deal instead of waving the threat of one around.

**Cost and timeline: **Collaborative divorce is more expensive than mediation but cheaper than litigation. This is because of the additional professionals involved — two attorneys and neutral experts. Its cost is around $15,000+ per spouse, depending on case complexity as well. Timelines depend on how complicated things are, but they generally run several months, right alongside the six-month waiting period.

**Who it’s for. **This route suits couples who want their own lawyer in the room and the steadying hand of financial or co-parenting experts, but who are genuinely set on avoiding a brawl. It’s especially handy when the finances are tangled, or when keeping a workable co-parenting relationship intact really matters.

### 3. Joint petition for dissolution

This is the big thing for amicable couples seeking mutual divorce as the Senate Bill 1427 introduced on Jan 1, 2026, created a new [joint petition for dissolution](https://thecompletedivorce.com/fl-700-joint-petition-california/), which has [many benefits](https://thecompletedivorce.com/californias-new-joint-petition-divorce/) and amongst two are that; (1) it  lets cooperative spouses file together as co-petitioners, (2) Couples pay a single filing fee.

While traditionally, in California, one spouse has to be petitioner while one has to be respondent, no matter how cooperative and friendliest couples were — This approach has been costlier and makes split look like a fight. 

The joint petition has no tight eligibility restrictions unlike summary dissolution as it allows any couple that agrees on everything, no matter how long you were married, whether you have kids, or how complicated your finances are. 

The trade-off is that it still requires **full financial disclosures** (the Declaration of Disclosure, FL-140, and its supporting schedules), and you still wait out the mandatory six months. 

### 4. Summary dissolution (for the simplest cases)

[Summary Dissolution](https://thecompletedivorce.com/summary-dissolution-in-ca-divorce/) also offers couples a “no-court” divorce option. It’s for short and simple marriages — meaning it’s not for everyone, because of its strict eligibility requirements. Qualifying couples have the fewest forms and no court appearance.

Here are its eligibility requirements, and every one must be met to opt for it:

– The marriage or domestic partnership must be less than 5 years (counting from the date of marriage to the date you separated).

– The marriage or partnership has no minor children together (born or adopted before or during the marriage), and neither spouse is pregnant.

– Neither spouse wants spousal support — both of you permanently give up the right to it.

– You don’t own or owe much. This applies to community property, debts, and interest in real estate. (A residential lease is fine, but only if it ends within a year and has no option to buy.)

– You meet California’s residency requirement: one spouse has lived in the state for six months and in the filing county for three.

– Both spouses have read and understood the FL-810 information booklet and have agreed, in writing, on how to divide everything.

**How long it takes**: Like other California divorces, summary dissolution also has a six-month cooling-off period, which cannot be waived. The clerk handles the paperwork and mails you the judgment.

### 5. The standard uncontested divorce

OK, so what if you have slight disagreements? Not every couple can pursue a joint petition, and some have a marriage or domestic partnership of more than 5 years.

That’s fine, because you can still divorce outside of court — or even without a lawyer — using a standard uncontested divorce.

In a [standard uncontested divorce](https://thecompletedivorce.com/steps-to-uncontested-divorce-california-without-lawyer/), one spouse files the Petition (FL-100) and the other responds, or the couple works out a [Marital Settlement Agreement](https://thecompletedivorce.com/california-marital-settlement-agreement-guide/) and hands it to the judge for a signature.

You’d usually pick this route when you need temporary orders while the case is pending, or when one spouse goes quiet and you have to move ahead by default. Either way, it still finishes on paper, with no trial.

An out-of-court divorce typically presents fewer problems due to each party focusing on reaching an agreement rather than pursuing a lawsuit. When parties cooperate, the process tends to be administrative rather than adversarial. The typical process for most uncontested divorces features:

1. Spouses agree on how to divide property, debt, child support, spousal support, and custody.
2. One spouse files for divorce with the Court and the other responds; or the parties file a joint petition.
3. Proper service of divorce documents (unless filed jointly)
4. Parties exchange financial information as required by the California Courts.
5. A written marital settlement agreement is drafted.
6. Parties submit all necessary documentation for finalization by the Court.

 

Even though parties avoid hearing(s) and/or trial(s), the Court does review and finalize the divorce.

## When Divorce Might Require Court Proceedings?

Divorce litigation usually occurs when couples do not agree on primary divorce issues or need legal protection. Litigation increases the stress and expense of divorce; delays it, and exposes private aspects of a couple’s life to public scrutiny. 

The lengthy litigation process can also negatively impact a parent-child relationship and increase the financial burden through attorney fees, hearings, and discovery.

Court involvement becomes more likely when there is:

- Dispute about child custody.
- The potential for hidden or deceitful behavior with respect to assets and/or finances.
- Concerns regarding domestic violence.
- Dissatisfaction with how alimony/support or asset/property distribution has been addressed.

However, not all disagreements go to trial. Instead, many couples use alternative dispute resolution methods, such as mediation, negotiated settlement agreements, or collaborative law, before letting the case escalate to trial.
