The term “nullity” or “annulment,” [according to California Courts](https://sf.courts.ca.gov/self-help/divorce-separation-annulment), refers to a court ruling that a marriage or registered domestic partnership has been deemed never validly entered into by law based on reasons that made the relationship void from its inception. 

A legal annulment impacts your civil status regarding a marriage, whereas a religious annulment does not affect your civil marital status. An annulment, like legal separation, does not have the same six-month residential requirement nor waiting period to file. 

Annulments are initiated with [Petition (Form FL-100)](https://thecompletedivorce.com/california-divorce-forms/) which is the exact form that would be filed in a divorce. An annulment can not be granted if you have previously completed a divorce.

## What is Divorce Action in California?

A divorce, which is referred to as a dissolution of marriage in legal terms, is the legal process that terminates a valid marriage. 

It also dissolves registered domestic partnerships. Not all unhappy marriages qualify to be annulled. There are specific legal grounds and qualifications that need to be met in order to get an annulment; those show that the marriage was invalid right from the beginning. 

Void marriages were always illegal (e.g., bigamy, incest). Voidable marriages are legal until a judge finds them invalid due to some circumstance (fraud, force, mental illness, etc.) and/or lack of consent. Irreconcilable differences and incurable insanity cannot invalidate a marriage. 

Those are the only two legal reasons for getting divorced, and they terminate what would otherwise be a valid marriage-not annulling it.

### 1. Grounds for Annulment

A judge will only [grant an annulment](https://selfhelp.courts.ca.gov/divorce-california/annulment) if you can provide evidence of a known legal basis for the request (bigamy, incest, fraud, force, mental illness, physical inability, marrying before age of majority without proper consent). 

Short marriage, just falling in love with someone else, agreeing mutually to terminate the 

marriage, etc., are NOT legal bases. 

If your spouse wants an annulment, you could also oppose their request and alternatively choose to divorce your spouse or seek legal separation. 

The time required to establish residency in California, or the six-month waiting period, does not apply to annulments, since the Court is simply deciding whether there was ever a valid marriage. 

### 2. Grounds for Divorce

California is a “no fault” state. Therefore, a dissolution proceeding must be based solely on either [Irreconcilable Differences](https://thecompletedivorce.com/irreconcilable-differences-california-divorce/) or Incurable Insanity. 

Generally, one spouse must reside in California for six months prior to filing for a dissolution proceeding, and within the county where they intend to file for three months. The divorce cannot be finalized until at least six months and one day after service of process on the Respondent (the non-petitioner). ## Annulment vs Divorce – The Key Differences

To better understand annulments versus divorces, it is important to know that both actions serve completely different purposes. 

An annulment requests that the court rule that a couple’s marriage was never valid or legitimate, whereas a divorce simply terminates a valid marriage. 

In addition to serving different legal purposes, annulments and divorces will differ in their grounds (the reasons for obtaining one), as well as their applicable residency requirements, waiting periods, property rights during the process, and ultimately, the final outcome for each spouse.

Another alternative for married couples seeking the same type of court-ordered decisions (as those made when either an annulment or divorce is requested) but are unable to or do not wish to end their marriage is through legal separation.

### 1. The Final Outcome

Both an annulment and a divorce result in being single again; however, they do so through different means. A divorce recognizes that the marriage did occur, and then legally terminates it. Conversely, an annulment states that the marriage was never legally recognized as such. 

 

As a result, where an annulment regards the marriage as invalid from its inception, matters such as property distribution, spousal support (and possibly others) would only be applicable if one party qualified as a “putative” spouse. Divorces, conversely, typically contain provisions addressing ongoing obligations and responsibilities, including support and property.

### 2. The Certain Timeframe

Another area of difference includes timing. California divorces cannot be finalized until at least six months have passed since service upon the respondent or since the respondent has appeared in the case. There is no six-month waiting period required by law to finalize an annulment. 

Therefore, the time needed to obtain an annulment could potentially be shorter based solely on how quickly the Court can find sufficient evidence to establish valid grounds for the annulment. 

Some annulment grounds require filing within a certain timeframe (typically 4 years), which varies depending on the specific legal grounds for the request.

### 3. Complexity

Obtaining an annulment is usually more difficult than obtaining a divorce. California is considered a “no-fault” divorce state. This allows you to file for divorce without having to prove your former spouse engaged in any wrongdoing during your marriage. 

 

The person requesting an annulment bears the responsibility to provide proof that there existed a legal basis for the annulment at the time of their marriage. 

 

Even if both parties consent to the annulment, the decision on whether the legal elements necessary to terminate a marriage have been satisfied is ultimately up to the Judge.

### 4. Assets and Marital Property Division

Property rights vary greatly. While the court will split community property and debt based upon California law when you get divorced, you retain ownership of all separate property along with some specific exemptions. 

Unlike a divorce, where the court can allocate property as part of its decision regarding spousal support in addition to dividing marital assets, in an annulment, the court can’t divide any property or provide spousal support unless it first finds that one party was a “putative” spouse, which means he/she truly believed that their marriage was valid. 

When this happens, the court could possibly divide what has come to be known as “quasi-marital” property, the property acquired during the relationship.

### 5. Marital Actions

An annulment and a divorce are two entirely different legal remedies. An annulment renders an invalid marriage null and void from inception, whereas a divorce dissolves a marriage that was valid when formed. 

As such, there is a difference in how you would deal with issues related to property rights, financial obligations, and the court’s rationale for rendering a judgment. Therefore, the decision to file either an annulment action or a divorce action is a very important decision.

### 6. Certain Time Limitations

Anytime you meet the state’s residency requirement, you can typically file for divorce. On the other hand, the statute of limitations varies depending on the grounds for annulment. 

For example, most void marriages can be challenged at any time, while many voidable marriages have statutes of limitation ranging from 2-4 years. 

Once the statute of limitation expires, you no longer have the right to obtain an annulment-even though you had valid grounds when you were initially married.

### 7. Court Proceedings

Unlike a typical divorce proceeding, annulments virtually always require the judge to review evidence and decide whether the marriage was legally invalid. 

Even if both parties agree to the annulment, it still requires approval of the court. Many times, however, a contested hearing isn’t required for an uncontested divorce.

### 8. Eligibility

Eligibility is probably the most significant distinction between an annulment and a divorce. An annulment typically requires a proven legal basis to obtain (bigamy, incest, fraud, duress, or lack of legal capacity), while divorce will allow you to get divorced without proving “fault,” with California residency being the only requirement. 

Additionally, there is no 6-month residency or waiting period with an annulment; however, this is required for divorce.

### 9. Custody and Support Obligations

An annulment will not terminate your responsibility as parents if there are minor children involved. However, the court may establish parentage when necessary and issue orders regarding child custody, parenting time, and child support, just as it does in divorce. 

The main difference is that spousal support and property division are more restrictive in annulment proceedings except where putative spouse rights are applicable.

### 10. Marital Agreements

Prenuptial and postnuptial agreements are usually far more applicable to divorces, since the marriage is considered legally valid and, therefore, many issues must be resolved regarding property division and spousal support.

 

In an annulment proceeding, the first thing the court must do is determine whether a valid marriage ever existed. Based upon the specific circumstances presented and the findings made by the court, a marital agreement may have virtually no effect and may render each party ineligible as a putative spouse.

## How to Decide between Annulment, Legal Separation, and Divorce Actions?

Choosing the best legal option will depend on your situation and whether you are eligible for an annulment in California.

If you do not have this eligibility or simply would like to terminate a legitimate marriage that does not require showing legal reasons to end it, then perhaps divorce or legal separation is your option.

- **Consider divorce if:** You want to legally terminate a valid marriage; divide property between you and your spouse; resolve issues of custody or support for children; or you do not qualify for an annulment.
- **Consider annulment when: **The marriage was based on bigamy, incest, fraud (with intent to deceive), force (coercion by threat or violence), unsound mind at the time of marriage, underage marriage, or physical incapacity that prevented consummation (sex) after the wedding.
